S1320 Summary: Another loopy Idaho bill. (1) Prospective only for adoptions finalized on or after July 1, 2022;  (2)  Requires matches and release of OBC through state-run Voluntary Adoption Registry (mutual consent)  Here is where it really gets loopy: (3) Includes a birthparent redaction “right”  for biological parents when a  match is made on the registry. though clearly, the parent has already agreed by signing on to the registry; (it gets better!) (4) Mandates a minimum 30-day “cooling off” period  (like when buying a gun (for a biological parent to decide if they really want information released or to decide to request redaction. of the OBC.  Finally the piece de loopy: (5) these regulations also apply to international adoptions. which of course the State of Idaho has nothing to do with except to issue a Certificate of Foreign Birth. The state does not have the OBCs of international adoptees.

Due to Louisiana’s unique inheritance laws, which generally do not eliminate an adopted person’s right to inherit from biological parents, lowering the age to 18 or 21 will likely kill any bill that does so. SF 328 Summary:  Carry-over from 2021 session. This bill constitutes a necessary step toward dismantling a complex system that has existed in Minnesota since 1977. The bill includes unrestricted access to  OBCs to all adoptees 18 and over, whose certificate was generated by the state and a genuine CPF. All Disclosure. Vetoes on file will expire on June 30, 2022.  A detailed memo explaining each of the sections in the Senate bill is here. Sen. Carlson withdrew SF328 in part to avoid discriminatory amendments and to keep the bill active during Minnesota’s two-year legislative process, but it is now back on the table. Neither this bill or its companion currently carries support by adoptee rights organizations

HB 1018 Summary: One of the most reactionary anti-adoptee/adoptee rights bills we have seen in quite a while; clearly an attack on HB168/SB2350. “Any adoptee eighteen (18) years of age or older may file with the bureau at any time a request to provide the adoptee with his or her original birth certificate and with any other available identifying information about a birthparent’s identity and location. Upon receipt of such request, the bureau shall contact the birthparent, regardless as to whether such parent has filed an affidavit under paragraph (a) of this subsection, to notify him or her of the request. Upon agreement from a birthparent, the bureau shall provide the requested information regarding only the parent who agreed to the release of identifying information.”

A 5141 Summary:  Carry-over from 2021 session.(Seems to be refiled with same number)  Can someone explain what this is about? The bill went nowhere last session. New York already enjoys full OBC rights so this bill is baffling.  Official bill summary says, “Grants access to a certified copy of the birth certificate of an adopted person without requiring judicial review; requires such birth certificate to state that the certificate is a certified copy of a sealed record and is not valid for identification with the adoption facts recited.” Appears to create an “integrated birth certificate”  that includes both biological and adoptive parent information, which the majority of adoptees reject. Hopefully, it won’t go anywhere. again.

S275 Summary: Creates central collection and location of all adoption records in the state; mandates feasibility study from Department of Children and Families to determine collection and distribution administration. Provides adoptee “access” to records, with provisions for redactions and the balance of  “privacy interests” of birthparents before releasing information. Includes redaction of any identifying information in certain records where no “waiver of confidentiality”  (Disclosure Veto) has been previously filed. Identifying information would be  released to an adult adoptee (or the adoptee’s descendant) only if “the person’s specific interest in the identifying information outweighs the privacy interest of the former parent.” (aka “good cause.”) Number of factors weigh in on the decision to release ID information including the determination of a “less intrusive” way for information to be obtained.

Due to the state’s long history of amending down unrestricted bills, and the January 5, 2022, Senate hearing (linked on the BN Wisconsin State page), we believe this bill is set up to continue the state’s confusing, discriminatory access law and is ripe for restrictions and conditions that deform groups will accept. The bill also conflicts with SB 524 (see below) , which passed the Senate last year and is now in the House.

HB4699 Summary: Amends the Abandoned Newborn Infant Protection Act. Picks up where HB 4227 leaves off. Makes SH surrenders and subsequent adoption easier for birthparent(s) and public and private child welfare services.  Relevant parts: Extends age of infant eligible for SH surrender from 7 days to 30 days. Provides that there is a presumption that by relinquishing a newborn infant under the Act, the infant’s parent waives notice of any legal proceeding to terminate his or her parental rights. Provides that first responders dispatched in response to a 9-1-1 call to accept a relinquished newborn infant must accept the relinquished newborn infant in accordance with the Act. Contains provisions on when and to whom a fire station or emergency medical facility must disclose the name and location of the hospital to which a relinquished infant was transported. Provides that, if possible, a hospital, police station, fire station, or emergency medical facility that receives a newborn infant must offer information about the relinquishment process to the relinquishing person in writing or by referring the person to a website or other electronic resource. Eliminates current information packet available to parent(s).  Amended language attempts to hide fact that babies are run through private adoption agencies (though public can be used). Shortens from 60 to 30 days child is eligible for adoption proceedings to start.  Mandates erasure of identity of child and parents (if known) from court records. Limits putative father rights. Contains provisions on a child welfare agency’s authority to place the infant in an adoptive home, foster home, child care facility, or other appropriate facility and to make medical and health-related decisions for the infant. Contains provisions concerning notice to the infant’s biological parents of legal proceedings to terminate their parental rights; the appointment of a guardian ad litem to represent the infant’s interests; petitions to return the infant to the infant’s parent; the alternative to relinquishment that results in the adoption of a relinquished infant under 30 (rather than 7) days of age; and other matters.

Provides an affirmative defense in certain criminal prosecutions and civil proceedings regarding child abuse or neglect to a parent who safely delivers his child within the first 30 days of the child’s life to a newborn safety device located at a hospital that provides 24-hour emergency services or at an attended emergency medical services agency that employs emergency medical services personnel. The bill also provides civil and criminal immunity to such hospitals and emergency medical services agencies for injuries to children received through such newborn safety devices, provided that (i) the injuries are not the result of gross negligence or willful misconduct and (ii) the hospital or emergency medical services agency meets certain requirements regarding the establishment, functioning, and testing of the device. Current law requires the child to be delivered within the first 14 days of the child’s life at such hospital or emergency medical services agency.

HR 1247/S 397 Summary: Carry-over from 2021 session Makes unregulated custody transfers a form of child abuse and neglect under federal child-welfare law. Specifically, an unregulated custody transfer occurs when a child is placed with a non-relative or otherwise unfamiliar adult, with the intention of severing the parental or guardian relationship with the child, without reasonably ensuring the child’s safety, and without legally transferring parental or guardian rights. The bill also requires the Department of Health and Human Services to (1) report on the causes, effects, and prevalence of unregulated custody transfers; (2) develop policy recommendations for preventing such transfers; and (3) issue guidance to the states.

Stronger Child Abuse Prevention and Treatment Act

HR 485 Summary: Reauthorizes through FY2027 and revises the Child Abuse Prevention and Treatment Act and the Child Abuse Prevention and Treatment and Adoption Reform Act of 1978 to expand services for preventing and treating child abuse.

Specifically, the bill establishes requirements concerning collecting and exchanging data about child abuse and neglect. For instance, the bill requires the Department of Health and Human Services (HHS) to (1) establish uniform national standards for tracking and reporting child fatalities and near fatalities resulting from maltreatment, and (2) develop an electronic interstate data exchange system that allows states to share information from their child abuse and neglect registries with other states.

The bill also addresses child abuse and neglect related to families impacted by substance use disorders, racial bias in the child protective services system, and child sexual abuse.

Further, the bill revises the community-based grants program to emphasize access to effective services for diverse populations and to promote the development of statewide strategies to scale up family strengthening services.

Finally, the bill requires HHS to examine unregulated custody transfers and make recommendations for preventing, identifying, and responding to such transfers.

H.R.6505 – Child Tax Credit for Pregnant Moms Act of 2022

HR 6505 Summary: This is not an adoption-related bill per se, but nonetheless a bill to watch. The bill’s goal is to incentivize pregnancy/discourage abortion by creating a tax credit for pregnant people for their unborn, born and in some cases miscarriages and stillbirths. It could be used by adoption agencies to encourage relinquishment, although in most cases potential birthparents do not have the income to qualify.
