Thank you for your email.

The adoption process is deeply personal and sensitive and in bringing forward this amendment, we want to be respectful to all parties involved. Our goal is to find a balance between individuals who wise to remain private and those who wish to have full access to their adoption information.

Before bringing forward this amendment, our department did collect and take into consideration a lot of information including what we had heard from the approximately 145 Islanders and non-Islanders who provided input through a consultation process.

The veto option and contact preference are a standard practice across Canada in jurisdictions that have opened their adoption records.  In fact, in 2007, the Superior Court of Ontario determined that not having a veto or no-contact preference would be considered unconstitutional. There are many individuals, both adult adopted and birth parents, who at the time of adoption did not think that their identifying information would be shared.

In terms of information sharing, our current Adoption Act allows for birth parents and adult adoptees to request non-identifying information from Post Adoption Services about their adoption. Birth parents can also receive confirmation of the adoption and the province where the adoption took place.

Our amendments will allow for more information to be gathered by birth parents and by adult adoptees. Birth parents can receive access to the adopted name of their child through the adoption order. In addition, adult adoptees can access their birth name and the name(s) of their birth parent(s).
