California AB1302: Emergency Action Alert–April 19, 2023 Deadline

Bastard Nation is sharing the CalOpen Partners Action Alert on AB1302.  This bill came out of nowhere and is the most Draconian and adopteephobic bill filed in 30 years or more. While the bill purports to support adoptee rights it makes it more difficult than it is currently to obtain OBCs by creating a large complicated bureaucratic and redaction system.

To the Honorable Assemblymember Jim Wood, Chair, and Members of the California State Assembly Health Committee,
I seek your NO Vote on AB 1302 (Lackey.) Vital Records.
This bill places increased restrictions on adult adoptees and creates new privacy rights to birthparents, regarding access to the original birth certificate. Namely: Redaction Rights and a Disclosure Veto. The bill requires affirmative consent from either or both birth parents in order to release the original unredacted birth certificate of an adoption occurring prior to 2025, but requires express refusal from either or both birth parents in order to withhold the certificate.
For births after 2025, the birth parent may indicate, once located, that they refuse to authorize a copy of the original and unredacted birth certificate to be provided to the adopted person. The bill prohibits the State Registrar from providing a birth certificate, if notice was not received by each birth parent listed on the birth certificate, as indicated by the fact that the State Registrar has not received the return receipt acknowledgment.
AB 1302 would create a clumsy, cumbersome, and unduly burdensome TRIPLE notification procedure in the hands of the Department of Health. While no fiscal note is yet attached to the bill, I can imagine the cost in millions will fall on adoptees and other voters in California.
For all these reasons, and in the name of equality, I strongly urge you to VOTE NO on AB 1302.
