New York Adoptees Need  Your Help Immediately!

Below is the Action Alert issued by New York State Adoptee Equality regarding A 5036A—-a very restrictive  bill–that  passed out of committee on May 16, 2017. NYSAE is not a Bastard Nation partner, but we are in full agreement with its opposition.  We will have more to say about this bill later.

Dear Assemblymember ______________,

I, along with NYS ADOPTION EQUALITY, remain opposed to pending legislation, most recently modified as A5036A.

Current law allows NYS adopted adults to ask a Judge to release their Birth Record. A5036A does NOT restore access to adopted people but creates new privileges for those whose parental rights were terminated or surrendered.

Most people in your district wrongfully believe that, upon attaining the age of 18, an adopted person is given not only their birth record but their “entire file” including the reports of any time in foster care: the works.

A5036A is bill language crafted by Sheldon Silver’s office. It is not adoptee rights but a holdover of accommodations to special interest groups.

This is NOT restoration of adoptee access to their own birth record when the consent of (former) parents (considered legal strangers) is required. Legal strangers do not not need State notice that an adopted adult is doing genealogy or, simply, wants an accurate record of their birth as every other NYS resident is entitled to. These legal strangers were not allowed to make decisions for their adopted out offspring as children; why should they be allowed to do so when said children reach the age of majority?

A Judge deciding what is in the best interest of a “birth” parent with no mention of the best interest of the adopted adult is NOT adoptee rights. Giving new rights to people who currently have none is NOT adoptee rights.

I encourage you to VOTE NO on A5036A, It is regressive and further discriminates against adopted adults. Please replace the word “adoptee” with any other minority group (i.e.: Black/Hispanic/Jewish/Muslim/LGBTQ/etc) and ask yourself if you would support such a bill. Adopted Adults are discriminated against and treated as minorities. It is long past time to end the Tann/Lehman Legacy and the discrimination against adopted adults.

Adopted adults deserve access to a true and accurate record of their birth just as every other adult born in NYS can access.
